Terms and Conditions of Hire 2024
Holiday Bookings and Payment terms
The contract will be held between the client and the owners Mr & Mrs Byford. The contract will exist from when the client provisionally books there holiday on our website and pays the deposit and ticks the agreement box subject to our booking terms and conditions.
The lead client must be 18 years or over when the accommodation booking is made. A confirmation will automatically be issued back to the clients email address on completion of the form and payment of the deposit. A deposit of a 3rd of the total rental fee is due when booking the holiday (the amount to pay for the deposit is worked out for the client on our booking page).
The balance shall be payable 10 weeks before the start of the holiday rental and the client is responsible for the balance of such rental charge, which shall be paid through our web site and direct to the owners. Non payment of the balance of the rental charge shall be construed as a cancellation of the contract by the client and the owners reserve the right to cancel the holiday booking and forfeit the deposit paid by the client. The client will have no claim against the owners for compensation or reimbursement whatsoever.
Bookings made less than 10 weeks before the commencement of the holiday rental must be accompanied by payment of the rental charge for the holiday period in full along with the booking form completed and ticked to agree with our terms and conditions.
Cancellations
In the event of the client cancelling there holiday, this must be sent in writing to the owners. The owners strongly recommend that the client arranges a comprehensive travel insurance policy (including cancellation cover) and to have full cover for all parties personal belongings, public liability etc, since these are not covered by the owners insurance.
We the owners will do our utmost to re-let the holiday barn if you have to cancel, but this is not always possible. If we are able to re-let the holiday barn for the whole period we shall refund all monies paid less an administration fee of £30.00 per booking. If the owners are unable to re-let the holiday barn at all then all monies paid by the client shall forfeit to the owners.
Holiday Accommodation
The main client, who must be part of the holiday group and over 18 will be responsible for losses and breakages to enable us to repair or replace for the new incoming clients at the earliest opportunity. If the client causes any breakages or damage during the holiday they must report this to the owners as soon as possible and reimburse the owners with the cost of replacement prior of departure.
The client must keep the holiday barn and all furniture, equipment etc in or on the barn in the same condition and state of repair as at the commencement of the holiday. To ensure at the end of the holiday the property is Left in the same condition and cleanliness in which it was found. Not to use the property for any illegal or commercial purpose, not to sublet the property or any part thereof or otherwise allow anyone to stay in it who we have not previously accepted on behalf of the owners as a member of your party. Not to behave in anti-social manner, breach the peace or otherwise act in a way which may disrupt or affect the enjoyment of others. To notify all other members of the client's party of these conditions. To allow the owners access to the barn at any reasonable time during the period of the holiday.
Unreasonable behaviour - The owners of all properties can refuse to hand over their property if the unreasonable behaviour of anyone in your party is likely to cause offence to other guests, to members of staff or to neighbours, or if the owner has reasonable cause to believe you or any member of your party will cause damage or loss to the property, it's services or facilities. If this happens, the contract between you and the owner will end and you will not recieve any refund and the owner will not have any further responsibility to you.
The owners of the properties can end a stay after keys have been handed over, if the unreasonable behaviour of anyone in your party (including anyone invited into the property by you) is likely to spoil the enjoyment, comfort or health of other guests, residents, neighbours or members of staff or where you or any member of your party (or anyone invited into the property by you) has broken or is likely to break any of these booking conditions, the owners terms and conditions or any other terms and conditions applicable to the property which you have been told about. If this happens, you will have to leave the property immediately and no refund will be given.
All property of the client, including cars and contents is entirely at their own risk at all times and the owners shall not accept no liability for any loss, damage or injury howsoever caused.
We will not accept any bookings for hen or stag parties or groups under the age of 18 years old. Parents are held responsible for their children's safety and behaviour at all times, or the Dame of the client on the booking form.
Our barns have other properties in close proximity and we have a zero tolerance policy on late night noise, all music must be kept to a minimum and turned off by 9pm.,all outside music is strictly prohibited in consideration to other holiday clients. If we do receive complaints regarding noise levels you will be requested to leave.
Dogs - We accept one well behaved dog (except in Skylark's Nest) under the following conditions. They can be exercised on our land but must be kept on a lead, you must clean up after your dog. We request you keep them off the beds and furniture. They are to sleep in there own beds. They are not to be left unattended in or on our premises in any circumstances. Any extra cleaning or damage will be charged for.
Smoking is strictly prohibited in the barns. The owners reserve the right to invoice you £100.00 if we feel we cannot re-let a barn due to the smell of smoke after your departure. This additional charge will cover the cost of cleaning all fabrics and furnishings to re-present the barn as a non-smoking property to our next clients.
All clients to arrive after 4.30pm on the arrival date and to vacate the barn by 10am on the departure date. The owner shall not be obliged to offer the barn before time stated and the client shall not be entitled to remain in occupation after the time stated.
The maximum number of people to stay overnight in the property must not exceed the number entered on the booking form. You cannot arrange for visitors to the property without the advance consent of the owner. You must not hold events ( such as parties, celebrations or meetings) at the property. If you do any of these things, the owner can refuse to hand over the property to you, or can repossess it. If the owner does this, we will treat this as you cancelling the booking. In these situations you will not receive a refund of any money you have paid for your booking. And the owner will not be legally responsible to you as a result of this situation. (This will include, for example, any costs or expenses you have to pay due to Not being able to stay in the property, such as the cost of finding other accommodation). The owners are not under any obligation to find any alternative accommodation for you.
The client shall report to the owners without delay of any defects in the barn or breakdown in the equipment or appliances in the barn, arrangement for repair or replacement will be made as soon as possible.
Use of any of the facilities and premises is at your own risk, everything in them, all the adjoining barns, the outside space, BBQ, Wood burner etc are used entirely at the clients risk and the responsibility of the lead client, they will also be responsible for the whole groups behaviour, actions and any damage caused. The owners will not be held responsible in any way.
